How to Handle Security Deposits
The law regarding Security Deposits
is very clear and if not done the right way, a Landlord waives his/her right to
any claims. Whether an owner, property manager, or rental community they all
must comply.
If you are making a
Claim against the deposit – Landlord must send out a notice of the
claim within 30 days from the date that Tenant vacates the Property. Failure to
do so will result in Landlord having to return the full amount of the deposit
to Tenant no matter how much he/she owes to Landlord.
Be aware Tenant will have 10 days
to object to the claim. If no response is received from tenant after notice is
sent, Landlord must deduct the amount of the claim from the Security Deposit
and return the balance to Tenant within
30 days from the date you sent out the notice.
If you are returning
the Full Security Deposit – Landlord does not need to send out a
notice. Simply return the full amount within
15 days from the date that Tenant vacates the property.
